        Home warranty regulations in Texas

        Home warranties, also known as service contracts, are regulated by the Service Contract Regulatory Act in Texas. As of Sept. 1, 2021, this act is enforced by the Texas Department of Licensing and Regulation (TDLR).

        According to the Service Contract Regulatory Act, warranty companies in Texas must maintain one of these three financial security items in order to protect consumers:

        • A reimbursement insurance policy
        • A funded reserve account and a security deposit
        • A net worth of at least $100 million

        Each customer in Texas must, by law, be given their own copy of the service contract with enough time to cancel and receive a full refund.

        Based on Texas law, service contract providers also have to allow buyers to cancel their service contract at any time. If you cancel before the 31st day of your contract, you’re eligible for a full refund with no cancellation fee (minus any claims paid). If you cancel after that, the warranty company must give you a prorated refund, and they can charge up to $50 in cancellation fees.
